LIFE* PERSONAL DATA PROTECTION POLICY

A. INTRODUCTION & BACKGROUND FACTS THAT YOU SHOULD KNOW

This Personal Data Protection Policy explains the information that LIFE* collects when you use its products, utilities and services via browsing activity to the Website, how that information is used, with whom it may be shared and your privacy choices.

LIFE* provides information, products, utilities and/or services related to telecommunication service via LIFE*’s website at www.getlife.com.my (“Website”) including but not limited to call, short messages service (sms), mobile internet data and other services which would be made available for all LIFE* users from time to time.

In LIFE*, we take your privacy seriously and we will only collect, record, hold, store, use and/or process your personal data or information as outlined below. We appreciate and thank for your precious time in going through our Personal Data Protection Policy (to be referred as “the PDPP”) for a better user engagement with LIFE*.

  1. We strongly believe that data protection is a matter of mutual trust and your privacy is important to us. We shall therefore only process your name and other information which relates to you in the manner set out in the PDPP including but not limited to the existing legislation, sub-regulations, policies and/or regulatory guidelines (whichever is applicable).
  2. We will only collect data or information where it is necessary for us to do so and for you to enjoy a safer data protection experience in using our LIFE*. We will only collect data or information if it is relevant to our dealings or transactions with you. We will only keep your data or information for as long as we are either required to do so by law or as is relevant for the purposes for which it was collected.
  3. We practice compulsory user’s registration inter-alia to ascertain the real and actual identity of every users of LIFE*. As such, in order to use LIFE*, you are unable to choose to remain anonymous and we must be able to identify your personal identity by providing and disclosing your personal data to us during the process of registration with LIFE* including but not limited to procure certain identity verification or factors authentication steps to do so.
  4. We are committed to protecting all personal data or information kept by us and providing you with the highest levels of customer service within our capabilities. We therefore hereby set out a number of personal data protection principles concerning the exercise and/or process of your personal data or information.

    For the purpose of this PDPP, the definition of some salient terms including but not limited to the following:
    1. “Personal Data”
      means any personal data or information relating to LIFE*’s mobile based or website registered user that has been provided to LIFE* or made available to LIFE* due to his/her direct user terms and conditions or agreement with LIFE* and/or via any other agreement signed and entered between you and LIFE*, the legal and beneficial owner of the Website which upon the establishment of such contractual relationship, it shall be deemed that LIFE* has been given consent to collect and process the user’s personal data which is in the possession, control and management of the authorised entity governing the operation and management of the premises, e.g. name, identity card or passport number, address, contact number, account number, payment history and/or account activity that relates directly or indirectly to an individual to the extent that the individual can be identified or is identifiable from such information.
    2. “Sensitive Personal Data”
      means and including but not limited to the personal data or information relating to your physical or mental health condition, political opinions, religious beliefs or other beliefs of a similar nature, commission or alleged commission of any offence or any other personal data determined by existing legislation; and
    3. “3rd Party”
      means an individual, incorporated or unincorporated entity who is not a party to a contract or a transaction with LIFE* but excluding LIFE*’s authorised agents, subsidiaries, contractors, sub-contractors and professional advisors or representatives.
  5. By registering for, downloading, or using the Website, you agree to accept this PDPP. LIFE* hereby expressly reserves the right to amend, alter or change any portion of this PDPP. We will announce such amendments, alterations or changes through our dedicated webpage.
B. SCOPE OF THE PERSONAL DATA PROTECTION POLICY
  1. This PDPP applies to all operations and business units of LIFE*. We are responsible for the users’ access and correction of personal data or information, notice and choice process to limit processing of personal data or information. We also responsible for monitoring the administration of this PDPP and its compliance. LIFE* do not knowingly collect information of persons whom are under the age of majority as per the laws governing LIFE*.
  2. This PDPP is effective upon the confirmation and successful registration with LIFE*. For the avoidance of doubt, this PDPP is valid and binding upon every subscribers and users regardless whether you have subscribed the services of LIFE* directly or indirectly.
C. SCOPE OF THE PERSONAL DATA PROTECTION PRINCIPLES IN THE PDPP
  1. GENERAL PRINCIPLE
    1. 8.1. LIFE* will use, process, record, hold, store, share and disclose (“the Process”) the Personal Data with your consent during your course of dealing with us in any manner, among others, for the following purposes:
      1. to upload, use, share video and/or commence live streaming;
      2. to purchase or sell permissible products or subscription of services;
      3. to process and complete transactions with LIFE* and to use and access to LIFE*’s services;
      4. to process, manage and maintain the all the LIFE* user’s access account and other applications;
      5. to process any payment or refund due under the access account or to enjoy the online payment features;
      6. for data processing, updating of any databases and customer service related matters;
      7. to communicate with the relevant governing entity, including to extend your queries/inquiries, complaints to them and to enable them to generally resolve your concern/disputes; and
      8. for any other purpose that is incidental or ancillary or in furtherance to the above purposes.
    2. 8.2. Your continuance of use of LIFE*’s Website or services shall nevertheless amount to your consent for the processing of the Personal Data by LIFE*;
    3. 8.3. LIFE* will record and maintain a record or register of consent by your continued use of our Website and/or services as appearing on our active customer database; and
    4. 8.4. If you are under age of majority, you should ensure that you have obtained the consent of your parent(s) or legal guardian(s) before using any services on LIFE* or browsing the Website.
    5. 8.5. LIFE* does not sell, share or trade your Personal Data collected or processed with any unauthorised third party(ies), unless consented by you;
    6. 8.6. When you register a user account with LIFE*, the Personal Data that we may collect and process would include but not limited to your:
      1. Name;
      2. Email address;
      3. Residential address;
      4. Date of birth;
      5. Gender;
      6. Contact number;
      7. Identification number;
      8. Photo;
      9. Transaction trail or activity data.
    7. 8.7. LIFE* does not collect and process any data or information regarding to your credit or debit card details including the payment methodology. The payment gateway offered by LIFE* does not belong to LIFE* but authorised third party, vendor, supplier and/or service provider. LIFE* does not retain such data or information instead of the parties mentioned above or your own respective bank or financial institutions;
    8. 8.8. Despite the above, LIFE* may also collect your Personal Data from a range of sources including but not limited to any events, activities, contests, promotional activities, surveys, social media tools or pages;
    9. 8.9. The Personal Data that we collect from you will be used and share within our group of entities and to authorised third party for one or the following purposes:
      1. to process, manage and/or verify your actual identity;
      2. to maintain, upgrade and/or improve LIFE* and/or our services to you from time to time;
      3. to perform and/or validate your access into any Services or features provided by LIFE*;
      4. to allow us administer, maintain and/or support your registered account with us;
      5. to verify and carry out financial transactions in relation to payments you may make online via LIFE* such as the process of the financial information or payment made through LIFE* will be processed by the appointed agent, vendor and/or supplier as such disclosure is necessary for the purpose of conducting the sales transaction(s) that you have opted for;
      6. to communicate with you and to maintain, upgrade and/or improve our customer relationship with you including to provide customer support to you;
      7. to conduct market surveys and/or research, customer profiling and its analysis, usage and activity trends pertaining to LIFE*;
      8. to protect and/or enforce parties’ legal rights including but not limited to initiating or defending any legal proceeding;
      9. to detect, investigate or prevent any fraudulent or illegal activities or misuse of the LIFE* for illegal purpose and/or purposes or intention that violates the legislation or any governmental policies;
      10. to transfer, assign and/or validate the parties’ rights, interests and/or obligations under any contractual agreement entered between us;
      11. for LIFE*’s internal administrative work purposes;
      12. in addition to the Personal Data that mentioned or outlined aforesaid, you may be asked to subscribe to our marketing and/or promotional materials including but not limited to activities below which may come from our group of entities or through affiliation with authorised third party(ies), if any. You are at your liberty and choice to unsubscribe from marketing information at any time by opting for the unsubscribe function within the electronic marketing material or available options:
        • announcements on products, services, contests, events, activities, promotions, campaigns, offers or surveys by LIFE*;
        • to send seasonal or festive greetings or messages to you;
        • events or activities organised or jointly organised by us and our business partners which may be of interest to you;
      13. Your data pertaining to the activities in using LIFE* may be stored with us or authorised third party(ies) but may not be retrieved directly by us, depending on the circumstances from time to time. However, you may access and view such information by logging into your account on the website, if such data is made available by us. You undertake and guarantee to treat the Personal Data that can be accessed by you confidentially and not make it available to unauthorised third party(ies). We cannot and would not assume any liability for any misuse of passwords unless this this misuse is through our own fault.
  2. NOTICE AND CHOICE PRINCIPLE
    1. 9.1. Please be informed that LIFE* will process your Personal Data for the following reasons and subject to your choice but possible limitation of services, may disclose the Personal Data to:
      1. individuals, companies, organisations or entities for the performance of LIFE*’s contract of providing any services to you;
      2. profiling your service preferences;
      3. individuals, companies, organisations or entities for compliance with any legal and/or regulatory obligations to which LIFE* is subject, in addition to any obligation imposed under LIFE*’s contract with you;
      4. other service providers or 3rd Parties nominated by LIFE* either solely or jointly with other service providers for the purposes of establishing and maintaining a common database of customers or processing data as an outsourced entity both within and outside Malaysia (if required) towards the common target to serve you better and accomplished your experience in using LIFE*;
      5. send you information, promotions, updates and newsletters including marketing and advertising materials or related or similar contents in relation to our services and those of organisations selected or nominated by LIFE*;
      6. regulatory bodies or other government authorities in compliance with requirements or compulsions under any legislation or orders or towards the detection, assistance, investigation or prevention of any criminal activities;
      7. any parties involved in or related to a legal proceeding in the courts of law in Malaysia and for the purposes of such proceedings;
      8. protect LIFE*’s vital interests;
      9. for the administration of justice and/or facilitating the legal or justice system in Malaysia;
      10. promote any of the LIFE*’s services, or products, services and special offers of 3rd Party whose products and services we think may be of interest or beneficial to you; and
      11. for the exercise of any functions, responsibilities or obligations conferred on any person by or under any legislation, law and order of courts of law in Malaysia.
    2. 9.2. LIFE* collects personal data from the user account registration in order to assess your needs and provide you better service. LIFE* may transfer your personal data to third parties both in Malaysia and overseas providing outsourced data storage or data processing services for LIFE*.
    3. 9.3. Any customers who have provided your personal data prior to this PDPP may inform LIFE* using the contact details set out below to know what types of Personal Data have been processed and the purpose of the processing.
    4. 9.4. Save in accordance with this PDPP and except as permitted or required under any enactment, law, regulations, statute or code, LIFE* will not use or disclose the Personal Data without prior written consent.
    5. 9.5. You will be given the opportunity to ‘opt-out’ of having your Personal Data used for purposes not directly related to the services of LIFE* at the point where we ask for information. If you do not wish to receive our promotional updates you may opt-out of receiving these communications by contacting LIFE* at the methods listed below. Please take note that should you decide to ‘opt-out’, we may not be able to provide you with certain services and your subscription.
  3. DISCLOSURE PRINCIPLE
    1. 10.1. LIFE* will only disclose the Personal Data to comply with any government agency notification requirements and/or for the purpose for which the Personal Data is processed where you have consented to disclosure;
    2. 10.2. LIFE* may from time to time contact you on behalf of external business partners about particular goods, offers or services that may be of interest to you. In those cases, the Personal Data that may identify you will not be transferred to the third party. All communication whether from LIFE* or LIFE*’s business partners will be sent to you by LIFE*;
    3. 10.3. Despite the above, LIFE* may still disclose some of your Personal Data to the following third parties for legitimate purposes, such as:
      1. your immediate family members and/or emergency contact person as may be notified to us or requested by us from time to time, if any;
      2. any individual or entity that under a duty of maintaining confidentiality to whom has undertaken such duty to keep your Personal Data in confidential engaged by us;
      3. professional advisers appointed or engaged by us including but not limited to lawyers, auditors, accountants and others;
      4. data centres or servers situated outside Malaysia to process or store the Personal Data where you hereby expressly consent to us to transfer your Personal Data out of the country(ies) other than Malaysia which might not provide or offer the same or better level of data protection measures;
      5. insurance company(ies) to apply and obtain insurance policy(ies), if any;
      6. to the public at large when you become the winner in any contests or activities;
      7. any other or relevant party pertaining to any proposed or actual corporate restructure activities, merger or acquisitions, sale, consolidation, joint venture, assignment, transfer, funding or realisation of assets, share sale relating to any portion of LIFE*’s business or in the highly unlikely event of insolvency, bankruptcy, winding up or receivership whichever is applicable.
    4. 10.4. The failure to provide your Personal Data may lead to the consequences that we are unable to enable the functions, features and operation of the LIFE* to you and you will not be able to enjoy the LIFE*.
  4. SECURITY PRINCIPLE
    1. 11.1. LIFE* is responsible for taking prudent steps to safeguard the confidentiality and security of all Personal Data, including appropriate procedural, organisational and technical steps to protect Personal Data from accidental or unlawful destruction or accidental loss, alteration or disclosure. These steps include entering into written agreements with subcontractors who process Personal Data in accordance with LIFE*’s instructions and incorporating LIFE*’s own data protection standards as a minimum;
    2. 11.2. We will place or procure various reasonable security measures to safeguard all Personal Data that has been collected or processed by us within our reasonable and commercial capacity as the internet / online or cloud-based transmission is not a 100% secured medium of communication;
    3. 11.3. LIFE* ensures that all information collected and processed will be safely and securely stored. We protect your Personal Data by:
      1. allowing access to Personal Data via passwords;
      2. securely destroying your Personal Data when it is no longer needed for our record retention purposes.
    4. 11.4. LIFE* does not accept responsibility or liability for any unauthorised access, loss, unlawful interceptions, hacking activities, installation or download of prohibited or unwanted software including but not limited to spyware, malware or virus which caused the loss of the Personal Data transmitted to or from LIFE* after performance or procurement of such reasonable security procedures that are within the commercial capacity of LIFE*.
  5. RETENTION PRINCIPLE
    LIFE* in executing its responsibilities with respect to the confidentiality of Personal Data, LIFE* will employ a number of safeguards, appropriate to the sensitivity of the information, to protect Personal Data against loss or theft, as well as unauthorised access, disclosure, copying, use or modification. Such safeguards will include physical measures, organisational measures and technological measures, for example locked filing cabinets, restricted access to offices, security clearances and limiting access on a “need to know” basis and use of passwords and encryption. Procedures for implementing these measures will be communicated to all LIFE*’s employees and third parties to ensure compliance with this principle.
  6. DATA INTEGRITY PRINCIPLE
    1. 13.1. LIFE* strives to maintain complete, current and accurate information about its customers. Any inaccurate information that is brought to LIFE*’s attention will be corrected as quickly as possible after notification. Procedures will be maintained to ensure that any reported inaccuracies are promptly and effectively handled and that customers’ information remains as accurate, current and complete as possible;
    2. 13.2. You are obliged to provide your Personal Data to LIFE*. Failure to provide a complete and correct information to LIFE* as required in the LIFE*’s Website may result in your registration with LIFE* be declined and the offers and services to be provided in consequential.
    3. 13.3. We may take reasonable steps to ensure that the information or the Personal Data provided by you is accurate, complete and not misleading and that such Personal Data is kept up-to-date and meanwhile, you are also responsible to do the same.
  7. ACCESS PRINCIPLE
    1. 14.1. Any person dealing with LIFE* can have access to his or her Personal Data that LIFE* has in its possession or control and may request that his or her Personal Data be amended for purposes of accuracy and completeness subject to such written request or notification be provided to LIFE*;
    2. 14.2. Under such circumstances, you may request to access or request for a copy of your Personal Data that held by us or to request to update or rectify the accuracy of your Personal Data which may subject to a minimal administrative fee to cover the costs involved in processing your request to access to your Personal Data;
    3. 14.3. You may also opt to rectify or update your previous Personal Data that has been registered and/or collected by LIFE* by editing your profile on the “Settings” page on the website or to inform our officer in-charge of personal data protection. However please take note that you may not delete information that has been associated with any past transactions.
  8. SENSITIVE PERSONAL DATA
    1. 15.1. LIFE* does not collect and process any Sensitive Personal Data in its ordinary course of business;
    2. 15.2. If need arises, LIFE* will obtain explicit consent from you before it collects and processes any Sensitive Personal Data;
    3. 15.3. LIFE* may process Sensitive Personal Data without your consent only in limited circumstances as permitted by law, if any.
  9. OUR WEBSITE (TO BE READ WITH OUR TERMS AND CONDITIONS)
    1. 16.1. Subject to development and circumstances from time to time, LIFE* may provide products, utilities and services via our dedicated website(s). When you visit our website the web servers will generally record anonymous information such as the time, date and URL of the request. This information assists LIFE* to improve the structure of its website(s) and monitor the performance. From time to time LIFE* may also use third parties to analyse this anonymous information;
    2. 16.2. As mandatory in the usage of the LIFE*’s websites, LIFE* may require standard information such as login ID, password, Personal Data for verification purposes, contact details and/or identification information. This information is necessary for LIFE* to provide the products and services you are subscribing for. You are required to maintain your secrecy of own login ID and password enabling the access to the LIFE*’s website(s) or app. It is strongly stressed that LIFE* will not be able to secure the Personal Data if you choose to reveal your own login ID and password to anyone and as such, is not liable for any breach or leakage of Personal Data.
  10. YOUR IP ADDRESS(ES), COOKIES AND OTHER CAPTURES
    1. 17.1. LIFE* may collect your Internet Protocol (IP) addresses if you choose to browse or login into your account via LIFE*’s website or app. IP addresses are assigned to computers or mobile devices on the internet to uniquely identify them within the network. LIFE* also collects and manages IP addresses as part of the service of providing internet session management, if any and for security purposes;
    2. 17.2. LIFE*’s website(s) may transmit to your computer a feature known as ‘cookies’. It is a package of data that allows LIFE*’s server to identify and interact more effectively with your computer instead of having to spend more time on identifying each user and/or visitor, thereby also providing additional login convenience. However, you are at your liberty or choice to configure, personalise the app or web browser to refuse, reject or even delete such cookies;
    3. 17.3. LIFE* may also collect and/or record the information that your browser sends whenever you visit our website including but not limited to browser type, webpage that you were visiting before you came to our website, the pages that within LIFE* you visit, time spent on these pages, items and information searched for on our website, access times and dates and other statistics which are not specifically mentioned herein;
    4. 17.4. The computer data and/or information other than Personal Data as mentioned aforesaid may be collected for analysis and evaluation in order to assist to improve the website, services and products we provide and will not be used in association with any other Personal Data.
  11. INTEREST BASED ADVERTISING (IBD)
    LIFE* or LIFE*’s Website may collect and process your Personal Data and/or anonymous information about the web browsing activity of a customer internet-enabled device and use that information to associate your browser with one or more pre-defined interest categories. This enables LIFE* to provide advertisements to you that are tailored to your interests. IBA is a way of making the advertisements on the websites you visit more relevant to you. It makes the advertising more relevant to you for your convenience and interest.

    We are committed to protect the Personal Data of all customers and/or users.     In the event of any inconsistencies, errors, mistakes or discrepancies between the English version and other translated versions of this PDPP whether done by LIFE* or other unknown third party(ies), the English version shall prevail.

LIFE* Terms & Conditions

Please read our Service Subscription Terms & Conditions carefully –, you agree to be bound by them.
LIFE* is managed by Mbits Digital Sdn Bhd (Company No. 1125089-T) Additional Terms and Conditions specific to LIFE* will be made available on our Website www.getlife*.com.my These, including amendments to them, are hereby incorporated as an essential part of these Terms and Conditions, all of which are collectively referred to as “T&C.”

Confirmation
By registering for LIFE* and activating Services, you agree that:
You have read and fully understood all of the T&C. Your participation in LIFE* and use of the Service, upon activation, constitutes unconditional acceptance to be bound by additional terms specific to various Value Added Services and these T&C including its amendments. You confirm that you are competent to accept these T&C. You confirm that you are at least 18 years of age. The information you provided for registration is valid and accurate. Additionally, you agree to:

  1. Be a LIFE* Member of Digi Service.
  2. Update LIFE* of your registration information should there be any changes.
  3. Allow LIFE* to verify the information provided by you for the registration of LIFE* Membership and activation.
  4. Fully indemnify LIFE* for any fraud, misrepresentation, unauthorized or unlawful usage of any Service through your mobile number which resulted in loss, damage, costs or expenses.
  5. View and listen to LIFE* to continue providing attractive packages.
  6. Allow LIFE* accessing your account information

Digi Services
Digi Services means the mobile telecommunications services provided by Digi Telecommunications Sdn Bhd (Company No. 201283) (“Digi”) as part of LIFE*.

In relation to the Digi Services only:-

  1. All terms and conditions in relation to the use of the Digi Services are as set out in https://www.digi.com.my/support/tnc/plans/digi-prepaid/call-plans;
  2. By using the Digi Services, you hereby agree to the terms and conditions and / or fair usage policy (https://www.digi.com.my/support/tnc/general/others/fair-usage-policy) and / or Digi’s privacy notice (https://www.digi.com.my/support/tnc/general/privacy-notice/privacy-notice-en);

  3. The terms and conditions under (a) and (b) above shall collectively be referred to as “Digi Terms”.

  4. Digi reserves the right to vary, update and/or revise its terms and conditions at any time without prior notice. Please do visit Digi’s website to check on the latest terms and conditions. By you continue using the Digi Services upon such variation, update and/or revision, you are deemed to have agreed and accepted such variation, update and/or revision.
  5. In the event of any inconsistency or conflict between the LIFE* Terms and Conditions and the Digi Terms in respect of the Digi Services, the Digi Terms shall prevail to the extent that it is related to the Digi Services.

For the avoidance of doubt, Digi shall not be responsible for any services, whether or not such services are provided by LIFE* / Mbits, save and except for the Digi Services.

Acceptable Use
You are solely responsible for all acts or omissions that occur when being LIFE* Member. In addition, you agree to abide by the Malaysian Communications and Multimedia Commission regulations governing the use of mobile services, available at www.skmm.gov.my including but not limited to, agreeing that the Service may only be used for lawful purposes. You agree that you will not use the Service in a manner which will result in any criminal or civil liability for LIFE* and/or its related corporations. You are solely responsible for the content which you post or transmit through LIFE* Services and you acknowledge that or its related corporations are only the conduit for posting, distribution and transmission of data. By way of example and not as a limitation, you agree not to use the Service as follows:

  1. for any unlawful or immoral purposes or for any purpose which is against public interest, public order or national harmony; or
  2. to publish or cause to publish defamatory, infringing, obscene or other unlawful material; or
  3. in connection with the infringement of the copyright, patent, trademark, trade secret or other proprietary rights of any third party or intellectual property rights of publicity or privacy; or
  4. to post or transmit through the Service unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, privacy invading sexual/racially offensive or otherwise objectionable material of any kind or nature

SIM Card
All LIFE* SIM cards must be activated within 3 days of registration and in Malaysia only. LIFE* reserves the right to impose a charge for SIM card replacement. Your registered SIM card is not transferable without a written approval from LIFE*. You will be liable for all terms and conditions in this Agreement until LIFE* confirmed your transfer with a written notice

LIFE* Top Up and Validity
The validity period for each top up is listed in our web portal www.getlife.com.my. You will be notified via our app or website of the top up amount, total available credit and new validity period upon each successful top up. LIFE* is not responsible for, nor do we refund lost, stolen, misused, or damaged top up vouchers or PINs. All top up purchases are final and non-refundable, regardless of who actually uses or possesses the vouchers or PINs, with or without your consent. In addition, LIFE* is not liable for any loss or damage due to top up errors caused by the user of the coupon. Top up coupons and e-voucher PINs which have passed the expiry dates will not be usable. LIFE* is not liable for refunding or compensating expired top up coupons or e-voucher PINs.

Third Party Services or Products
LIFE* is not responsible or liable for any third-party services or products which you access, use or acquire through LIFE* Services or any third-party services or products that LIFE* has no absolute control whatsoever.

General
In addition to the Terms and Conditions contained herein, information published from time to time on LIFE* website, relevant to you as a LIFE* Member and continued use of the Service, shall be construed as and shall immediately be read as being part of these Terms and Conditions. LIFE* is not liable for any loss, damage, cost, personal injury or expenses suffered by you or any third party while utilizing our service as a result of the following:

  1. Matters beyond our control, such as but not limited to, act of God, mandate from regulatory authority, war, national emergency, strike, pandemic, diseases outbreak, accident, fire, lightning, equipment and electrical failure and/or malfunction.
  2. Any act, omission, error, default or negligence by LIFE* or our business partners.
  3. Service outage or downtime not due to the fault of LIFE*
  4. Unauthorized access or usage of LIFE* Services by third party.
  5. These Terms and Conditions will be governed by the laws of Malaysia.
  6. The Terms and Conditions herein are subject to change without prior notice and at LIFE* discretion.

General
The primary responsibility for the observance of the Code shall rest with each LIFE* Member. In case of any breach of the Code, LIFE* Members shall make every reasonable effort to satisfy the complainant.

Registration

  1. To register for LIFE* Prepaid, Subscribers shall provide an original copy of their National Registration Identification Card (NRIC) or passport to its appointed authorized dealer if they are on premise. Subscribers’ LIFE* prepaid account shall be deemed successfully registered upon receipt of an SMS confirmation from LIFE*.
  2. Subscribers must update their personal information stated in such registration with us from time to time when required.
  3. In the event of fraudulent activity, LIFE* reserves the right to disqualify any registration at its sole discretion.
  4. By registering with LIFE* , Subscribers represent and confirm that they are legally able to enter into the Agreement, AND that they have: –
  5. read, understood and accepted the terms and conditions herein; and
  6. Agreed to use the Services according to the terms and conditions as such.

Subscribers’ Responsibility and Obligations

  1. You are required to provide LIFE* with accurate and complete information and inform us in writing of any changes of the information provided.
  2. You are required to comply with all notices or directions issued by LIFE* from time to time in relation to the use of the Service and the SIM card.
  3. You shall take all reasonable steps to prevent spamming, fraudulent, defamatory, offensive, improper, immoral and indecent actions or illegal use of the Service.
  4. You shall ensure the compatibility of your Device with LIFE*’s System and the continued compatibility in the event of changes and/or upgrades.
  5. You shall be fully responsible for any voice or data transmitted or broadcaster by you or persons using your Device.

LIFE*’s Personal Data Protection Policy (“PDPP”)

  1. LIFE* is committed to protect and safeguard your personal data upon subscription of the Service in accordance to the Personal Data Protection Act 2010.
  2. Upon your subscription of LIFE*’s services, you will be given choice to agree to our PDPP. You may choose not to accept. However, your refusal to accept or agree to our PDPP may result in inaccessible to LIFE*’s services.
  3. The PDPP shall be read together with this Terms and Conditions. Kindly refer to the PDPP section in LIFE*’s website for further information.

Prepaid Subscriber Identification Module (“SIM”) Card

  1. Upon registration via LIFE* website subscriber will be provided with a LIFE* SIM Card. Risk passes to Subscribers immediately upon successful registration and collection.
  2. Subscribers must not interfere with or destroy the LIFE* Prepaid SIM Card for any reason or allow it to be handed over to any other carrier or service provider without our prior written approval. Any LIFE* Prepaid SIM Card that is lost, stolen or damaged (through no fault of ours or the manufacturer) will require payment from the Subscriber for its replacement, exchange or repair. Any LIFE* Prepaid SIM Card found defective due to faulty workmanship or design may be replaced free of charge once returned to us. Subscribers will be required to pay for all Service charges up to the time Subscribers notify us of the loss or theft of their SIM Card and their SIM Card is deactivated.
  3. Subscribers shall not copy or allow any other person to copy any pre-programmed data of any LIFE* Prepaid SIM Card.
  4. Subscribers are responsible for the safekeeping and usage of their SIM Card including the use by any other person whether or not authorized by the Subscriber.
  5. Subscribers must notify LIFE* immediately upon discovering their SIM Card has been lost or stolen or unauthorized use and agrees to lodge a report to Polis Diraja Malaysia (PDRM) or competent authority whenever instructed by LIFE* and to give LIFE* a certified copy of such report.

Prepaid Account Status, Charges, & Payment

  1. Subscribers may check via USSD call *128# for the latest information about their talk time credit or thru via LIFE* website. LIFE* shall not be liable for any loss, damage, costs or expenses arising from Subscribers’ failure to do so. Calls made locally from LIFE* sim card to LIFE* call centre 011-33777777 is charged.

LIFE* E-Wallet
E-WALLET TERMS & CONDITIONS
Definitions

In these Terms of Use, the following words have the meaning set out beside them:

“LIFE*”, “We”, “our”, “us” means MBITS DIGITAL Sdn. Bhd., a company incorporated in Malaysia bearing registration number 709922-X and having its business office located at Unit 6-1-1,QUEENS AVENUE BLOCK 6,1ST FLOOR JALAN BAYAM OFF JALAN PEEL ,55100 KUALA LUMPUR ,Malaysia

“e-Wallet” means the electronic money service offered by LIFE* to its subscribers only, a virtual mobile wallet for cashless transactions such as top up and purchase plan. An e-Wallet will be automatically opened for you with LIFE* for subscribing to the Service where your denial or refusal to use the e-Wallet will result in inaccessible to LIFE*’s services;

“Customer Service” or “Customer Service Team” means those individuals employed by LIFE* responsible for its customer service function who may be contacted at as stipulated via our contact page.

“Fees” means any and all Fees and charges levied by LIFE* for your use of the e-Wallet and its services.

“Member/You/Customer/Client” means any person who meets all eligibility requirements set out in these Terms of Use;

“Merchant” means any commercial or non-commercial entity that is validly registered with and approved by LIFE*;

“Self-care” means the self-managed portals to manage your own e-Wallet for LIFE* subscriber;

“Agreement” means this Terms and Conditions including any amendments and variations to the Terms and Conditions;

“Available Balance” means the equivalent of physical money which has the same par value in the System, which you can use at any given time subject to the limits herein imposed;

“Payment Gateway” means the authorized payment gateway appointed by LIFE* to act as remittance agent for the Service;

“Deposit” means the deposit of money in the e-Wallet in exchange for the Service via payment gateway Channels designated by LIFE*;

“Transaction” means the e-Wallet transaction performed by you via the service including but not limited to purchase or payment for goods or services, deposit, or refund service;

“Service Charge” means the commission and / or transaction charges payable by you for the utilisation of the Service (over and above the cost of the goods and services provided, if any) ;

“Refund” means the request refund for any Transaction completed under the Service;

“Withdrawal” means the withdraw from e-Wallet;

“Content” means any contest, java games, information text, sound, music, software, photographs, videos, graphics, data messages or other materials.

“Current Balance” means the balance available in your e-Wallet for your usage of the Service. For the avoidance of doubt, the amount reflected as the Current Balance shall include amounts deducted for pending transactions. You may check the balance in your E-Wallet through the LIFE* website.

“MSISDN” means the mobile number assigned to you by LIFE*;

“Prepaid” means the prepaid products and services offered by LIFE*;

“e-Wallet limit” means the limit per Transaction imposed by Bank Negara Malaysia for the Service in the sum of Ringgit Malaysia Two Hundred Only (RM200) unless otherwise informed by LIFE*. LIFE* reserves the right to amend the Wallet limit in accordance with the allowable limits set by Bank Negara Malaysia; you are not allowed to exceed the e-Wallet Limit per Transaction;

“Validity” means your e-Wallet validity is followed by the prepaid validity;

“e-Wallet Service” means the electronic money issuer and transfer service provided by LIFE*;

“You” or “Your” means the person who is authorized to use the Service subject to these Terms and Conditions herein;

“Transfer” means, as the context permits, (a) the debiting of an amount of electronic money from your e-Wallet and purchase our LIFE* plan or Member e-Wallet, in each case less any applicable Fees;

“Website” means the LIFE*’s website, or such other website through which LIFE* may offer the e-Wallet Service from time to time.

General LIFE* e-Wallet Rules
These rules form an agreement between you and us, Mbits Digital Sdn Bhd, whenever you use e-Wallet. You must read these rules carefully because they explain your and LIFE*’s legal rights and duties to each other. If you use any of the services available on your e-Wallet, you accept that these rules apply to you.

Use of LIFE* e-Wallet Services
The Service is made available by LIFE* to you at its sole and absolute discretion for the following purposes:

  1. Payment for any purchase of goods and services via online LIFE* websites;
  2. Deposit into your Wallet subject to the Wallet Limit ;
  3. To top-up own LIFE* prepaid e-Wallet

To access the Service, you shall not be required to register for the Service as long as you have sufficient amount in your e-Wallet

You acknowledge and agree that you are only permitted to use the Sites and the Services as expressly set out in these Terms and Conditions or on the Sites or third party terms and conditions applicable to the products and services, which may be posted from time to time in connection with such products and services.

You may view your e-Wallet Transactions at by logging into the LIFE* website portal.

Period of Agreement
This Agreement shall take effect from the Activation date of the mobile number and shall continue to be in force until terminated in accordance with these Terms and Conditions.

Minimum Age Requirements
By subscribing or using to the Service, you warrant that you are at least twelve (18) years of age, and in any event, have parental consent to enter into this Agreement, where although you are above twelve (18) years old, you remain under the legal age to enter into a contract.

These Rules Will Change From Time To Time
We can change these rules from time to time. We will tell you about changes that are important to the e-Wallet services by putting a notice about this on the LIFE* website. If you don’t agree to the changes you should not use the e-Wallet services anymore. If you use the e-Wallet services after we have given you this notice, we can assume that you have read, understood and agreed to these new rules.

Your Responsibility
You shall

  1. Provide accurate and complete information to LIFE* and inform LIFE* immediately of any changes in any particulars of your Personal Information.
  2. Ensure that you use the Sites and Services for your own personal use only;
  3. Ensure the compatibility of your Mobile Device with LIFE*’s System. In the event that changes and upgrades are introduced to LIFE*’s System, you shall be responsible to ensure the continued compatibility of your Mobile Device and you shall have no claim whatsoever against LIFE* arising there form;
  4. Comply with all notice or instruction given by LIFE* from time to time in relation to the use of the Service;
  5. Be responsible for all equipment and software necessary to use the Service and also for the security and integrity of all information and data transmitted, disclosed and/or obtained through the use of the Service;
  6. Be responsible for all usage of and charges for the Service including but not limited to payment of all the Service charges and any other related charges due to LIFE* pursuant to these Terms and Conditions in a timely manner;
  7. Be fully responsible for any data transmitted or broadcasted by you or persons using your Mobile Device;
  8. Comply with all applicable laws of Malaysia relating to the Service, including without limitation to the Communication and Multimedia Act 1998 and its subsidiary legislation, other acts, statutes, bylaws, rules and regulations issued by relevant government and regulatory agencies which may be amended from time to time;
  9. Take all reasonable steps to prevent fraudulent, improper or illegal use of the Service
  10. Cease to utilize the Service or any part thereof for such period as may be required by LIFE*;
  11. Report immediately to LIFE* upon the discovery of any fraud, theft, loss, unauthorised usage or any other occurrence of unlawful acts in relation to the Mobile Device and its use. You agree to lodge a police report whenever instructed by LIFE* and to give LIFE* a certified copy of such report; And
  12. Indemnify and shall keep indemnified LIFE* from any loss, damage, liability or expense, arising from any claims for libel, invasion of privacy, infringement of copyright, patent, breach of confidence or privilege or breach of any law or regulation whatsoever arising from the content transmitted, received or stored via the Service or part thereof and for all other claims arising out of any act or omission of your or any unauthorized use or exploitation of the Services or part thereof;
  13. Agrees, consents, allows and has no objection to LIFE* extracting Personal Information or any other data required to be used as evidence in court and/or when necessary in the event of a suspected and or proven misuse of the Service for you commercial gain purposes;
  14. Comply with the provisions of these Terms and Conditions;
  15. Comply with all applicable laws of Malaysia relating to the Service, including without limitation to the Communication and Multimedia Act 1998 and its subsidiary legislation, other acts, statutes, bylaws, rules and regulations issued by relevant government and regulatory agencies which may be amended from time to time; And
  16. Take all reasonable steps to prevent fraudulent, improper or illegal use of the Service
  17. Cease to utilize the Service or any part thereof for such period as may be required by LIFE* ;
  18. Ensure that any instructions given to us via the Service is accurate and complete; And
  19. Be responsible for all losses and payments (including the amount of any transaction carried out without your authority) if you have acted with gross negligence so as to facilitate that unauthorized transaction, or you have acted fraudulently. For the purposes of this clause, gross negligence shall be deemed to include failure to observe any of your security duties referred to in these Terms and Conditions.

You shall not:

  1. Use the Service to cause embarrassment, distress, annoyance, irritation, harassment, inconvenience, anxiety or nuisance to any person;
  2. use the Service for any unlawful purposes including but not limited to vice, gambling or other criminal purposes whatsoever or for sending to or receiving from any person any message which is offensive on moral, religious, communal or political grounds, or is abusive, defamatory or of an indecent, obscene or menacing character;
  3. Use the Service for any purpose which is against public interest, public order or national harmony;
  4. use, permit or cause to be used the Service improperly or for any activities which breach any laws, regulations, infringe a third party’s rights, or breach any directives, content requirements or codes promulgated by any relevant authority including activities which will require LIFE* to take remedial action under any applicable industry code or in a way interferes with other users or defames, harasses, menaces, restricts or inhibits any other use from using or enjoying the Service or the internet; Or
  5. Use the Service to transmit or post any content that contains any harmful, damaging or destructive programs;
  6. use the Service to receive, access or transmit any content which is obscene, pornographic, threatening, racist, menacing, offensive, defamatory, in breach of confidence, in breach of any intellectual property right (including copyright) or otherwise objectionable or unlawful;
  7. circumvent user authentication or security of any host, network or e-Wallet (referred to as “cracking” or “hacking”) nor interfere with service to any user, host or network (referred to as “denial of service attacks”) nor copy any pages or register identical keywords with search engines to mislead other users into thinking that they are reading LIFE*’s legitimate web pages (referred to as “pagejacking”),or use the Sites or the Services for any other unlawful or objectionable conduct. Users who violate systems or network security may incur criminal or civil liability, and LIFE* will at its absolute discretion fully cooperate with investigations of suspected criminal violations, violation of systems or network security under the leadership of law enforcement or relevant authorities;
  8. Use the Sites and/or the Services to advertise or offer to sell any goods or services for any commercial purpose without LIFE*’s written consent;
  9. hack into, make excessive traffic demands, deliver or forward chain letters, “junk mail” or “spam” of any kind, surveys, contests, pyramid schemes or otherwise engage in any other behavior intended to inhibit other users from using and enjoying the Sites and/or the Services or any other web site, or which is otherwise likely to damage or destroy LIFE*’s reputation or the reputation of any third-party;
  10. use, display, mirror or frame the Site , or any individual element within the Site, LIFE*’s name, any LIFE* trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without LIFE*’s express written consent;
  11. Access, tamper with, or use nonpublic areas of the Site, LIFE*’s computer systems, or the technical delivery systems of LIFE*’s providers;
  12. Attempt to probe, scan, or test the vulnerability of any LIFE* system or network or breach any security or authentication measures;
  13. Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by LIFE* or any of LIFE*’s providers or any other third-party (including another user) to protect the Site, Services or the Products;
  14. Attempt to download the Services through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by LIFE* or other generally available third party web browsers;
  15. Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation;
  16. Use any meta tags or other hidden text or metadata utilizing a LIFE* trademark, logo URL or product name without LIFE*’s express written consent;
  17. Use the Site or Services for any commercial purpose or the benefit of any third party or in any manner not permitted by these terms of use, unless expressly permitted;
  18. Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Site or Services to send altered, deceptive or false source identifying information;
  19. Attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Site or Services;
  20. Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail bombing the Site;
  21. Collect or store any personally identifiable information from the Site or Services from other users of the Site or Services without their express permission;
  22. Impersonate or misrepresent affiliation with any person or entity; Or
  23. directly or through the use of any device, software, internet site, web based service, or other means remove, alter, bypass, avoid, interfere with, or circumvent any copyright, trademark or other proprietary notices marked on the Products or any digital rights management mechanism, device, or other content protection or access control measure associated with the Service including geo filtering mechanisms.

LIFE*’s Rights

  1. LIFE* reserves the right to make any alteration or changes to the Service, or any part thereof, or suspend the Service or any part thereof by way of a twenty one (21) prior written notice sent via LIFE* App messaging. LIFE* shall not be liable for any loss or inconvenience resulting therefrom.
  2. Unless otherwise notified or requested in writing by you, you agree and consent that LIFE* may send you notifications relating to promotional and marketing activities from time to time.
  3. LIFE* may extract any details or Personal Information or any other data which is required to be used as evidence in court and/or when necessary in the event of a suspected and or proven misuse of the Service upon the receipt of any valid order by competent authority and courts of law.
  4. LIFE* may run campaigns/contest or promotions in relation to the Service or Content as maybe notified from time to time. You agree that your participation in such campaign/contest/promotion shall be subject to the specific terms conditions of such campaign/contest/promotion.

Proprietary Rights

  1. All trademarks used on the Sites and/or the Services are the trademark of LIFE*
  2. You acknowledge and agree that the Services and the Sites or any part thereof, whether presented to you by LIFE*, advertisers or any third party are protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. All rights are expressly reserved.
  3. You are only allowed to use the Sites and the Services as set out in the Terms and Conditions, and nothing on the Sites and/or the Services shall be construed as conferring any license or other transfer of rights to you of any intellectual property of other proprietary or non-proprietary rights of LIFE*.

Warranties and Responsibilities
You hereby undertake and warrant the following:

  1. You shall provide any additional information which LIFE* may request from time to time, failing which it may result in the suspension or termination of the Service by LIFE* at its sole discretion;
  2. The information provided by you may be held on a database and LIFE* may use, store, analyses and transfer and / or exchange such information with all such persons as may be considered necessary by LIFE* without reference to you;
  3. You will not breach any provision of these Terms and Conditions;
  4. You will comply with all applicable laws, ordinances, codes, rules, regulations, notices, instructions or directives of the relevant authorities or any notices, instructions, directives, or guidelines given by LIFE* in connection with the Services;
  5. You have not fraudulently registered an e-Wallet. If LIFE* discovers that you are impersonating another customer, whether an individual or another legal entity, you shall be responsible for any liability that may arise as a result of such fraudulent activity. Abusing the Services may result in immediate termination / suspension of the Services, and report to the relevant authorities You may be liable and/or punishable for criminal liability upon conviction;
  6. You shall not use the Services for any illegal or immoral activity or activity against public policy under all applicable and relevant laws;
  7. You shall be responsible for all your transactions and for keeping track of your e-Wallet. LIFE* may at its sole discretion provide you with any physical statement of e-Wallet and records of your transactions in respect of the e-Wallet;
  8. The use of the Service is subject to such other applicable specific terms, conditions, rules and regulations as specified by Bank Negara Malaysia and / or any other regulatory or governmental authority;
  9. The Service is not transferable or assignable to any third party without LIFE*’s written permission and shall be exclusively used by you. LIFE* shall not be liable for any costs, loss or damage (whether direct or indirect), or for loss of revenue, loss of profits or any consequential loss whatsoever as a result of your transferring or assigning the Service to any third party without LIFE*’s consent;
  10. The e-Wallet and / or the Service cannot be pledged or used in any manner as any form of security instrument for any purpose whatsoever. LIFE* shall not be liable for any costs, loss or damage (whether direct or indirect), or for loss of revenue, loss of profits or any consequential loss whatsoever as a result of your using the Service as a form of security instrument whatsoever;
  11. Be responsible for checking and verifying all transactions including, without limitation, the amount and recipient information. LIFE* shall not entertain any request to reverse a wrongful entry as a result of negligence.
  12. Immediately notify LIFE* upon receipt of incomplete and inaccurate data, or information or any data or information, which is not intended from LIFE* or any doubtful information or message. You shall delete such data or information from your Mobile Device;
  13. You hereby acknowledge that your name and MSISDN and such other personal information may be made available to another third party or Bank for verification and other lawful purposes;
  14. The Transaction being carried out is not always simultaneous with an instruction being given. Some matters may take time to process and certain instructions may only be processed during normal working hours, even though the Service may be accessible outside such hours;
  15. If you are below the legal age for contracting, have obtained the requisite consent of your legal guardians. Note further that in the event of any claims for fraud, negligence, libel, invasion of privacy, infringement of copyright, patent, breach of confidence or privilege or breach of any law or regulation whatsoever arising from the material transmitted, received or stored via the Servicer part thereof and from all other claims arising out of your use or exploitation of the Service or part thereof, LIFE* will join such legal guardian of yours as a joint defendant;
  16. Upon agree that LIFE* can act on any instructions given to us even if these instructions were not authorized by you;
  17. You request and authorize LIFE* to rely and act upon all apparently valid communications as instructions properly authorized by you, even if they may conflict with any other instructions given at any time concerning bill or service requirements; And
  18. You acknowledge and agree that in entering into the Terms and Conditions you do not rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether party to the Terms and Conditions or not) other than as expressly set out in the Terms and Conditions as a warranty. Nothing in this clause shall, however, operate to limit or exclude any liability for fraud.

Fees and Charges

  1. You shall pay the prevailing Service Fee and each of the Transaction charges for the Service. The applicable fees and charges shall be based on LIFE*’s prevailing rates notified to you from time to time;
  2. You shall be responsible for all related fees and / or charges imposed by the Banks
  3. You shall be responsible for any other charges for deposit, transaction and refund that LIFE* may impose from time to time.
  4. You will need to provide all equipment necessary to access the Sites and the Services on the Internet, and be liable for payment for your local telephone call and data charges at the rates published by the telephone operator with whom you make your local calls, or any other internet access charges to which you may be subjected to. If your equipment does not support relevant technology including but not limited to encryption, you may not be able to use certain Services or access certain information of the Sites.

Disclaimer

  1. This Service is provided on an “as is” and “as available” basis. LIFE* disclaims all liability and makes no express or implied representation or warranties of any kind in relation to the Service including but not limited to:
    – Availability, accessibility, timeliness and uninterrupted use of the Service; And
    – Sequence, accuracy, completeness, timeliness or the security of any data, information provided as part of the Service.
  2. LIFE* will use reasonable endeavors to ensure that the Service is secure and cannot be accessed by unauthorized third parties but does not warrant the security or confidentiality of any information transmitted through the System or such other equivalent system in any jurisdiction via the Service.
  3. LIFE* shall not be liable or responsible to you and / or to any other third party(s) for any costs, loss or damages (whether direct or indirect), or for loss of revenue, loss of profits or any consequential loss whatsoever as a result of your usage of the Service.
  4. LIFE* is not responsible for any transactions made through the Service. Any dispute, error and mistake in transactions must be resolved between you and the transacting party.
  5. Notwithstanding anything to the contrary contained herein, the maximum liability of LIFE* shall not exceed in aggregate the sum of Malaysian Ringgit Two Hundred (RM200)or an amount equivalent to the aggregate sum of balance and deposit (if any) of your e-Wallet at the date on which your claim arises, whichever is the lesser.

Governing Law and Dispute Resolution

  1. If you discover any error or discrepancy in your e-Wallet, you must contact the LIFE* Call Center within Sixty (60) days from the date of the disputed transaction, failing which, you shall be deemed to have accepted the accuracy of your Transaction.
  2. If it is revealed in the course of LIFE*’s investigation that the disputed Transaction was indeed made in error, LIFE* will refund the disputed sum.
  3. As far as practicable, refund request shall be processed between seven (7) to fourteen (14) working days upon valid acceptance of such request by LIFE*.
  4. LIFE* reserves its absolute right not to refund any disputed amount if LIFE* believes that you have acted contrary to or against these Term and Conditions.
  5. You hereby agree and consent to the disclosure and release by LIFE* of any information in the possession of LIFE* relating to you, the particulars of the transaction(s) or any designated e-Wallet relating to the transaction(s) for the purpose of investigating any claim or dispute arising out of or in connection with the transaction(s) under the Service which consent shall survive the termination of the Service.
  6. You hereby agree that in the event of a dispute or claim of any nature arising in respect of any transaction, the records of the transaction(s) available from LIFE* shall be used as a reference and shall be the sole basis of settling the aforesaid dispute or claim.
  7. These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia, and you hereby submit to the exclusive jurisdiction of the Malaysian courts or competent tribunal governing LIFE*.
  8. All refund documentations may be transmitted by mail/e-mail.

Fraudulent Use or Lost Mobile Device with Sim Card

  1. You acknowledge that the Service is and always remains the property of LIFE* and you shall:
    i. Exercise all due care and diligence in the custody, care and use of the Service; And
    ii. Not tamper or allow anyone to tamper with the e-Wallet or the Service.
  2. You must immediately notify LIFE*’s customer service and report to the police or competent authority for any loss, fraud, suspected fraud, dishonest use or theft of your Mobile Device with Sim card or illegal use of your e-Wallet. You will be liable for all charges incurred in relation to the lost / stolen Mobile Device with Sim card or fraudulent use of the Services until we receive notification from you as stated above for disconnection of the Services
  3. Notwithstanding the aforesaid, LIFE* may reject the use of the Service for effecting payment, if:
    i. The Service is suspected to have been fraudulently issued, stolen or tampered with; Or
    ii. LIFE* determines that the use of the Service poses a risk to the System; And LIFE* shall not be liable for any loss, cost or damage suffered, if any, by you as a result thereof.

Refund Policy

  1. If require a refund for any Transaction completed under the Service, contact the LIFE* Customer Service Call Center at 011-33777777 during working hour.
  2. Upon the request of refund dispute of transaction is received, LIFE* will take seven (7) working days for checking the dispute of transaction.
  3. Refund of e-Wallet credit balance (less any applicable fees) shall be completed within thirty (30) days upon the request for refund has been approved.
  4. If LIFE* has denied the refund, (i) LIFE* will get subscriber’s consent to withdraw the request of refund, or (ii) LIFE* will require subscriber to provide further information

Termination and Suspension and Withdrawal

  1. LIFE* may at its absolute discretion immediately terminate, suspend, the Service or change the procedures, the mode of operation of the Service without giving any reason or notice thereof.
  2. LIFE* reserves the right, at its absolute discretion and at any time, to immediately suspend / terminate your use of the Service for any reason, including but not limited to the following circumstances:
    1. if in the opinion of LIFE*, you have indulged or involved in any dishonest, fraudulent, illegal and / or criminal conduct or misrepresentation pertaining to the Service of LIFE*;
    2. if in breach of any of the provisions of these Terms and Conditions or have engaged in any conduct prejudicial to LIFE*;
    3. if in breach of any acts, statutes, laws, bylaws, rules and / or regulations imposed by any party, regulatory body, or government agency;
    4. if you have submitted false documents or have declared false information during your application for the Service;
    5. If you have acted with bad or malicious intent; And / or
    6. LIFE* is of the opinion that your acts are prejudicial to LIFE*’s interest.
  3. The Service will be terminated automatically if the e-Wallet has been terminated or expired due to MSISDN has been terminated (as the case may be) and / or Agreement with LIFE* is terminated or expired
  4. You may, at any time; or upon termination of the Service, request the withdrawal by contacting LIFE* HQ.
  5. Withdrawal of e-Wallet credit balance (less any applicable fees) shall be completed upon receipt of duly completed Service Request Form (e-Wallet Withdrawal), and photocopy of Registered Owner NRIC/Passport /Police/Military Identification.
  6. In the event where withdrawal amount is to be deposited to a third party Bank Account, additional supporting documents as per the followings may be required;
    1. Administration Letter or relevant court order and/or any other legal documentation which is sufficient to do so in the opinion of LIFE*;
    2. Death Certificate of Registered Owner and/or;
    3. Authorization Letter from Registered Owner and/or;
    4. Photocopy of Registered Owner NRIC/Passport /Police/Military Identification and/or;
    5. Photocopy of Third Party NRIC/Passport /Police/Military Identification.
  7. No withdrawal may be processed unless request for withdrawal with complete documentation is received within a period of six (6) months upon termination.
  8. All E-wallet withdrawal request form and documentations may be transmitted by hand/mail/fax/e-mail.
  9. Withdrawal of e-Wallet credit balance (less any applicable fees) shall be completed within thirty (30) days upon receipt of duly completed Service Request Form (E-wallet Withdrawal), and documents required.
  10. e-Wallet is followed by the MSISDN; you cannot terminate on e-Wallet itself unless and until you terminate or cease to use the Service absolutely or upon termination by LIFE*.

Amendment and Modification of the Terms and Conditions

  1. LIFE* reserves the right at its absolute discretion, from time to time, to vary, add to or otherwise amend these Terms and Conditions or any part thereof by way of a thirty (30) days’ notice period. Your use and continued use of the Service after the effective date of any variation, addition or amendments to these Terms and Conditions shall constitute your unconditional acceptance of such variations, additions or amendment. You are advised to visit the Site from time to time to keep updated of the latest variation to the Terms and Conditions (if any) which may or may not be specifically notified to you.
  2. LIFE* may, in its sole discretion, serve with a notice under these Terms and Conditions by posting such a notice on the Site or any other online or other medium, which LIFE* may introduce from time to time.

Indemnity

  1. You hereby agree to fully indemnify and to hold LIFE* harmless from and against any claim brought by a third party resulting from the use of the Sites and the Services by you and in respect of all losses, costs, actions, proceedings, claims, damages, expenses (including reasonable legal costs and expenses), or liabilities, whatsoever suffered, or incurred directly or indirectly by LIFE* inconsequence of such use of the Sites and the Services, or breach or nonobservance of any of the Terms and Conditions.
  2. You shall defend and pay all costs, damages, awards, fees (including any reasonable legal fees) and judgments awarded against LIFE* arising from the above claims, and shall provide LIFE* with notice of such claims, full authority to defend, compromise or settle such claims, and reasonable assistance necessary to defend such claims, at your sole expense.

Force Majeure

  1. Without limiting the generality of any provision in these Terms and Conditions, LIFE* shall not be liable for any failure to perform its obligations herein caused by an act of God, insurrection or civil disorder, pandemic, diseases outbreak, military operations or act of terrorism, all emergency, acts or omission of Government, or any competent authority, labour strike, trouble or industrial disputes of any kind, fire, lightning, subsidence, explosion, floods, acts or omission of persons or bodies for whom LIFE* has no control over or any cause outside LIFE*’s reasonable control.
  2. You shall remain liable to pay all fees and charges which are outstanding and/or due and payable to LIFE* despite termination of Service due to Force Majeure.
  3. The Service may occasionally be affected by interference caused by objects beyond LIFE*’s control such as buildings, underpasses and weather or atmospheric conditions, electromagnetic interference, equipment failure or congestion in LIFE*’s System or telecommunication systems. In the event of such interference, LIFE* shall not be responsible for any inability to use or access the Service, interruption or disruption of the Service.

Severability and Effect of these Terms and Conditions
If any of the provision herein contained should be invalid, illegal or unenforceable under any applicable law, the legality and enforceability of the remaining provisions shall not be affected or impaired in any way and such invalid, illegal or unenforceable provision shall be deemed deleted.

Waiver
LIFE*’s failure to exercise any right or provision of these Terms and Conditions, shall not constitute a waiver of such right or provision, unless acknowledged and agreed to by LIFE* in writing.
